1This Interim Decision addresses the consolidation of these Applications.
2The Tribunal has received ten Applications by the applicants listed in the style of cause alleging that the respondents discriminated against them contrary to the Human Rights Code. All ten Applications appear to arise from the very same set of factual circumstances and raise the same issues.
Consolidation
3By Case Assessment Direction (“CAD”) dated October 12, 2017, I proposed that the Tribunal consolidate all ten Applications and process them together. I advised the parties that they could make submissions in response to the proposed consolidation by October 19, 2017.
4No party objected to the consolidation and the time for doing so has passed. Therefore, all ten Applications are consolidated and will be processed together. As I noted in the CAD, the Tribunal is in the process of scheduling the Applications for a mediation since the parties have agreed to attempt a mediation in this case. I note that the respondent has not filed a Response to the Applications filed by Mr. and Mrs. Bateman, but they did not oppose my proposal to include all ten Applications in the mediation.
ORDER and direction
5These ten Applications are consolidated and will be processed together. The next step will be for the Tribunal to schedule a mediation and advise the parties of the date of the mediation by Notice of Mediation.
6I am not seized of these Applications.
