Introduction
1The applicant filed an Application under the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on May 2, 2017.
2On August 2, 2017, the Tribunal notified the applicant that, in its Response, the respondent had asked that the Application be dismissed on the basis that another proceeding had appropriately dealt with the substance of the Application. The Tribunal directed the applicant to file a Reply to this argument by August 23, 2017.
3On August 11, 2017, the applicant requested an extension for filing his Reply.
4On September 5, 2017, the Tribunal granted the applicant’s request, allowing him until September 19, 2017 to file a Reply. The Tribunal indicated at that time that the “remaining requirements in [its] August 2, 2017 letter remain[ed] as stated.”
5On September 7, 2017, the applicant requested a further extension to file the Reply.
6On October 2, 2017, the Tribunal granted the applicant’s request, allowing him until November 20, 2017 to file the Reply. The Tribunal advised that no further extensions would be granted, and that if the applicant failed to file his Reply by November 20, 2017, the Application might be dismissed as abandoned.
7The Tribunal sent its October 2, 2017 correspondence by email, to the address the applicant had previously used to communicate with the Tribunal. The email was not returned as undeliverable.
8The applicant has not responded to the Tribunal’s October 2, 2017 email and the time to do so has now passed.
ORDER
9In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
