DECISION
Adjudicator: Bruce Best
Date: December 4, 2017
Citation: 2017 HRTO 1610
Indexed as: Davis v. Doverhold Investments Ltd.
1The parties attended a mediation of this Application under the Human Rights Code, R.S.O. 1990, c.H.19, as amended (the “Code”) on October 4, 2017.
2The parties indicated that they had reached a settlement in principle at the mediation, and advised that they would confirm with the Tribunal by filing a Form 25 (Confirmation of Settlement) by October 20, 2017 that they had entered into a final settlement agreement.
3No Form 25 was filed by October 20, 2017. The Registrar followed up with the parties by letter dated October 27, 2017, requiring them to either file a completed Form 25 by November 10, 2017, or, if there was no settlement, that the applicant confirm that she intended to proceed to a hearing. The letter further indicated that in the absence of either of the above, the Tribunal could deem the Application to be abandoned and dismiss it on that basis.
4As of the date of this letter, the Tribunal has not received any further correspondence from either party. It appears that the parties have reached a settlement, but have failed to confirm the settlement with the Tribunal.
5In the circumstances, it is appropriate to dismiss the Application as abandoned.
ORDER
6The Application is dismissed as abandoned.
Dated at Toronto, this 4th day of December, 2017.
