1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on August 3, 2016.
2By letter dated October 19, 2016, the Tribunal deferred this Application pending the conclusion of ongoing grievance proceedings.
3On July 17, 2017 Tribunal wrote to the applicant. The applicant was asked to inform the Registrar in writing within 30 days whether the other proceedings remained ongoing and, if possible, to indicate when they were expected to be completed. The letter went on to warn the applicant that failure to provide the requested information might result in the Tribunal dismissing the Application as abandoned.
4The applicant responded on July 28, 2017 and advised the grievance is being held in abeyance pending the implementation of the respondent’s policy changes in their hiring and competition processes.
5By email dated July 28, 2017, the Tribunal directed the applicant to provide the Tribunal with an update on the grievance within 90 days from the date of the letter.
6The applicant has not provided a response to the Tribunal’s email dated July 28, 2017 and the email to the applicant has not been returned as undeliverable.
7In the circumstances, unless the applicant provides the update as directed by the Tribunal in its July 28, 2017 letter no later than November 24, 2017 this Application will be dismissed as abandoned.
