Visa Canada Inc. and Agueci and Calabretta Respondents
DECISION
Adjudicator: Eban Bayefsky Date: October 31, 2017 Citation: 2017 HRTO 1438 Indexed as: Tyszka v. Visa Canada Inc.
Introduction
1The applicant filed an Application under the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on July 5, 2017.
2On September 19, 2017, the Tribunal issued a Notice of Intent to Dismiss the Application (“NOID”) on the basis that the Application appeared to be outside the Tribunal’s power to decide. The Tribunal directed the applicant to provide submissions on the matter by October 19, 2017, failing which the Tribunal would make a decision based solely on the information in the Application, or might dismiss the Application as abandoned.
3The Tribunal sent the NOID by regular mail and email to the addresses provided by the applicant, and it was not returned as undeliverable.
4The applicant has not responded to the NOID and the time to do so has now passed.
ORDER
5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
Dated at Toronto, this 31st day of October, 2017.
