DECISION
Adjudicator: Mary Truemner
Indexed as: Hughes v. Yuan Chang Ltd. o/a Fu Yao Supermarket
APPEARANCES
Matt Hughes, Applicant
Self-represented
Introduction
1This Application alleges discrimination with respect to services contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The applicant believes that his race, ethnic origin and age were the reasons for which cashiers at the respondents’ grocery store treated him rudely, and appeared to be laughing at him while speaking loudly in what appeared to be Chinese, when he had communicated in English.
the hearing
2The hearing for this matter was scheduled for October 27, 2017 at 9:30 a.m. The applicant appeared at the scheduled time, but the respondents did not appear and the Tribunal stood the matter down for 30 minutes. The respondents had still not appeared at 10:00 a.m., and the applicant elected to withdraw his Application because he noted that the respondents had apologized in the Response and because he had filed the Application for the purpose of education only, intending to alert the respondents to his perception that they had violated his rights under the Code, and that they need to familiarize themselves with its provisions.
3In the circumstances, I orally allowed the applicant’s request to withdraw the Application.
ORDER
4The applicant’s request to withdraw the Application is granted.
Dated at Toronto, this 30th day of October, 2017.
