Introduction
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2Following a summary hearing the Tribunal dismissed all of the allegations in the Application except for the applicant's reprisal allegation. See Interim Decision 2017 HRTO 79.
3The hearing of the reprisal allegation is scheduled for November 3, 2017.
4The deadline for the parties' prehearing disclosure was September 19, 2017. The respondent made the required disclosure but the applicant did not.
5On September 28, 2017, the Tribunal issued a Case Assessment Direction ("CAD"). The CAD asked the applicant to confirm whether she intended to proceed with her Application, and, if so, it directed her to make disclosure as required under Rules 16 and 17 of the Tribunal's Rules of Procedure by October 4, 2017. The CAD warned the applicant that her Application might be dismissed as abandoned if she did not respond to the CAD. The Tribunal sent the correspondence to the email address and mailing address that the applicant provided in her Application and at which she consented to receive correspondence from the Tribunal. The mail was not returned to the Tribunal as undeliverable.
6The applicant did not respond to the September 28, 2017 CAD.
ORDER
7In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
