1A hearing in respect of this Application is scheduled for October 18 and 19, 2017 in Toronto.

2On September 29, 2017, the applicant sent an email to the Tribunal and copied the respondent. The email stated that the applicant will not be pursuing this Application. On that same day, the Tribunal sent an email to the applicant and copied the respondent in which it asked the applicant to complete and return an attached Form 9 Request to Withdraw an Application.

3On October 3, 2017, the applicant delivered to the respondent and the Tribunal a Response to a Request for Order During Proceedings. In this Response, he again indicated that he was withdrawing his Application.

4On October 11, 2017 the Tribunal issued a Case Assessment Direction in which it directed the applicant to serve on the respondent and file with the Tribunal a signed and completed Form 9 Request to Withdraw an Application on or before October 13, 2017.

5The Tribunal advised that if the applicant did not communicate with the Tribunal by October 13, 2017, the Application will be dismissed as abandoned.

6The applicant has not communicated with the Tribunal since October 3, 2017. As a result, the Application is dismissed as abandoned.
