1A hearing in respect of this Application was scheduled for October 4, 2017 in Toronto.
2In a Case Assessment Direction dated September 28, 2017, the Tribunal directed the applicant to comply with Rules 16 and 17 of the HRTO’s Rules of Procedure regarding pre-hearing disclosure of documents and witness statements.
3On October 3, 2017, the applicant sent an email to the Tribunal stating that he would not be pursuing this Application and would not be attending at the hearing on October 4, 2017. On that same day, the Tribunal sent an email to the applicant and copied the respondent in which it asked the applicant to complete and return an attached Form 9 Request to Withdraw an Application.
4Based on the information provided by the applicant, the Tribunal advised the parties that the October 4, 2017 hearing date had been cancelled. The applicant was again directed to file the Form 9.
5The applicant has not filed the completed Form 9 or communicated with the Tribunal since advising that he did not wish to pursue the Application. As a result, the Application is dismissed as abandoned.
ORDER
6The Application is dismissed.
