Human Rights Tribunal of Ontario
B E T W E E N:
Meagan Deavy
Applicant
-and-
Ann Marie Thompson
Respondent
DECISION
Adjudicator: Romona Gananathan
Indexed as: Deavy v. Thompson
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on July 8, 2016.
2Mediation was scheduled for August 24, 2017, on consent of both parties, but the applicant failed to attend.
3The Tribunal wrote to the applicant on August 30, 2017, asking her to confirm her intention to proceed with the Application no later than September 11, 2017. The letter warned the applicant that her Application may be dismissed if she did not respond by that date.
4The Tribunal's letter was sent to both the electronic and mailing addresses provided by the applicant. It was not returned as undeliverable. In the circumstances I am satisfied the applicant received the letter.
5The applicant has not responded to the letter and the time for doing so has passed. For these reasons I find the applicant has abandoned the Application.
ORDER
6The Application is dismissed as abandoned.
Dated at Toronto, this 29^th^ day of September, 2017.
