1This Application alleges a breach of settlement, under section 45.9(3) of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended.
2By letter dated June 16, 2017 the applicant was directed to advise the Tribunal, by June 30, 2017, whether he intended to proceed with the Application in light of the respondent's Response. The applicant failed to respond to that letter.
3On August 21, 2017, the Tribunal wrote again to the applicant directing him to advise the Tribunal of his position by September 5, 2017. The letter warned the applicant that a failure to respond by that date could result in dismissal of the Application as abandoned.
4The applicant has not responded to the Tribunal's direction and the time for doing so has passed. Both letters were sent to the email and mailing addresses provided by the applicant and have not been returned as undeliverable. In the circumstances I am satisfied the applicant received the letters.
5For these reasons I find the applicant has abandoned the Application.
ORDER
6The Application is dismissed as abandoned.
