1This Interim Decision concerns five Applications filed by the applicant against the University of Ottawa (“the University”) and the Association of Professors of the University of Ottawa (“the Association”). Some of the Applications are against the respondents separately and some are against both respondents. The most recent Application also names Jennifer Dekker as a personal respondent.

2The Applications in 2016-23479-I; 2016-26040-I; 2016-26436-I; 2017-26760-I were deferred pending the conclusion of a related proceeding at the Ontario Labour Relations Board (OLRB).

3In May 2017, the applicant filed a fifth Application in file 2017-28190-I. The respondents to that Application asked that it too be deferred. The applicant filed submissions in August 2017 opposing deferral.

4In September 2017, before that issue could be dealt with, the applicant filed a Request for Order During Proceedings asking that all the deferred Applications be re-activated. The applicant forwarded a Memorandum of Settlement in which the applicant withdrew the matter that was before the OLRB. The respondents have confirmed that the matter at OLRB has been resolved and that they do not object to re-activation of the Applications at this Tribunal.

5The Applications previously deferred are re-activated. The most recent Application in file 2017-28190-I will not be deferred.

6The respondents in the Applications 2016-26040-I, 2016-23479-I, 2016-26040-I and 2017-28190-I not yet filed a Response. The next step is for them to do so. Noting the number of Applications, the Tribunal will extend the time to file the Responses to November 24, 2017.

7Providing the respondents agree to try mediation at the Tribunal, the Tribunal will schedule a full-day mediation session for all five Applications. If any respondent does not agree to mediation, the mediation will deal with the Applications in which the respondent(s) do agree to try mediation.
