1The applicant filed an Application under the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on December 15, 2016.
2On April 11, 2017, this Tribunal issued a Case Assessment Direction directing, on its own initiative, that a summary hearing be held to determine whether the Application should be dismissed, in whole or in part, on the basis that there was no reasonable prospect that the Application or part of the Application would succeed.
3On May 16, 2017, the Tribunal issued a Notice of Summary Hearing to the parties, noting that the hearing would be held on July 26, 2017 by teleconference.
4On July 21, 2017, the applicant requested that the summary hearing be rescheduled. The respondent consented.
5On July 25, 2017, the Tribunal notified the parties that the summary hearing was cancelled, and directed the applicant to arrange new dates with the respondent for the summary hearing and to provide these dates to the Tribunal by July 31, 2017.
6On August 18, 2017, the Registrar alerted the applicant to the fact that he had not yet provided new dates for the summary hearing, and warned that if he did not respond as directed in the Tribunal’s July 25, 2017 letter by August 28, 2017, the Tribunal might deem the Application to have been abandoned and close the file.
7The Tribunal’s July 25, 2017 letter was sent by email to the address the applicant provided, and the Registrar’s August 18, 2017 letter was sent by regular mail and email to the addresses the applicant provided.
8The applicant has not responded to either the July 25, 2017 or August 18, 2017 correspondence, and the time to do so has now passed.
9In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
