DECISION
Adjudicator: Douglas Sanderson Date: September 12, 2017 Citation: 2017 HRTO 1195 Indexed as: Kershaw v. Cypher Systems Group Inc.
1These Applications were filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), and alleging discrimination with respect to employment. The Tribunal consolidated the Applications by letter dated January 23, 2017.
2By letter dated August 17, 2017, the Tribunal informed the parties that its records indicate that the parties have settled these matters, but have not filed a Confirmation of Settlement Form (Form 25). The Tribunal directed the parties to file a completed Form 25 by August 31, 2017, in order that the Tribunal may close the file on the basis of the settlement. The Tribunal advised that if it did receive a completed Form 25 or confirmation that the applicant intends to proceed with the hearing by August 31, 2017, then it may deem the Application to be abandoned and dismiss it on that basis. By e-mail message dated August 17, 2017, the applicant indicating that she had attempted to file a Request to Withdraw (Form 9) regarding both Applications, but had been unsuccessful. The Tribunal responded by e-mail on the same day and directed the applicant to file either a Form 25 or Form 9. The Tribunal also advised that the deadline for filing either a Form 25 or Form 9 continued to be August 31, 2017.
3As of the date of this Decision, the Tribunal has received neither a Form 9 nor a Form 25 completed by the parties. The applicant also has not confirmed that she intends to proceed with the Applications. In the circumstances, it appears the Applications have been abandoned.
4The Applications are dismissed.
Dated at Toronto, this 12th day of September, 2017.
