1The applicant filed an Application under the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on March 22, 2017.
2On July 13, 2017, the Registrar advised the applicant that, in its Response, the respondent had sought the dismissal of the Application on the basis that the applicant had signed a full and final release with respect to the issues raised in the Application.
3The Registrar directed the applicant to submit a Response to Request for Order During Proceedings (Form 11) giving the applicant’s position on the respondent’s request, by August 8, 2017, failing which the Tribunal would make a decision based solely on the information in the Application, or might dismiss the Application as abandoned.
4The applicant has not provided the required submissions, and the time to do so has long passed.
5The Registrar’s letter was sent by email to the address provided by the applicant, and was not returned as undeliverable.
6In all of the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
