1The applicant filed an Application under the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on December 27, 2016.
2On August 15, 2017, the Registrar advised the applicant that, in its Response, the respondent had sought the dismissal of the Application on various grounds. The Registrar directed the applicant to submit a Reply with submissions on these issues by September 5, 2017, failing which the Tribunal would make a decision based solely on the information in the Application, or might dismiss the Application as abandoned.
3The Registrar’s letter was sent by regular mail and email to the addresses provided by the applicant. The email attached the Registrar's letter and advised the applicant that he was required to respond as directed by September 5, 2017, or his Application might be dismissed as abandoned. Neither the letter nor the email was returned as undeliverable.
4In all of the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
