1Four applicants filed Applications against the respondent alleging that it violated the Human Rights Code, R.S.O. 1990, c. H. 19, as amended. The Tribunal consolidated the Applications and it is hearing them together.
2Shortly before the August 24-25, 2017 hearing dates of the Applications, Kelly Nolan advised the Tribunal by email that, although she supported the Applications, she intended to withdraw her Application due her inability to attend the hearing for work-related reasons.
3The Tribunal advised Ms. Nolan that she was required to complete a Form 9 (Withdrawal form) if she wished to withdraw her Application. Ms. Nolan has not done so but did not attend the first two hearing days on August 24-25, 2017.
4At the hearing, I advised the parties of the Tribunal’s practice to deem Applications abandoned if an applicant does not attend a hearing. Neither party objected to the dismissal of Ms. Nolan’s Application as being abandoned.
Order
5Ms. Nolan’s Application (file no. 2015-22991-I) is dismissed as abandoned. This proceeding will now be indexed by the Tribunal as Miller v. InterCounty Tennis Association.
