1The applicant filed this Application alleging discrimination contrary to the Human Rights Code, R.S.O. 1990 c. H. 19, as amended (the “Code”).

2On February 24, 2017, the respondent requested that the Tribunal dismiss the Application under s. 45.1 of the Code as another proceeding had appropriately dealt with the substance of the Application. The applicant did not respond to the request.

3By Case Assessment Direction (“CAD”) dated July 31, 2017, the Tribunal directed the applicant to respond to the respondent’s request, failing which the Tribunal would deem his Application to be abandoned.

4The applicant did not respond to the Tribunal’s CAD and the time for doing so has passed.

5In the above circumstances the Application is dismissed as abandoned.
