Human Rights Tribunal of Ontario
B E T W E E N:
Ruben Alijohn Applicant
-and-
Lucy Wang Respondent
DECISION
Adjudicator: Jo-Anne Pickel Date: August 21, 2017 Citation: 2017 HRTO 1089 Indexed as: Alijohn v. Wang
1A hearing of this Application was scheduled for August 23, 2017. On August 10, 2017, I issued a Case Assessment Direction (“CAD”) addressing the parties’ failure to make the pre-hearing disclosure required under the Tribunal’s Rules of Procedure. I directed both parties to make the required disclosure no later than 7 days from the date of the CAD, that is, by August 17, 2017. In the CAD, I specifically advised the parties about the consequences of not making the required disclosure or responding to the CAD. I noted that the consequence for the applicant was that the Tribunal might deem him to have abandoned his Application.
2I am satisfied that the applicant received the CAD as it was couriered to his sister’s address, which is the address he asked the Tribunal to use, and it was not returned as undeliverable.
3Neither party responded to my CAD and the time for doing so has passed.
4In filing applications with the Tribunal, applicants are commencing legal proceedings. The Tribunal has repeatedly found that applicants risk a dismissal of their application if they fail to follow the Tribunal’s directions. See, for example, Ouwroulis v. New Locomotion, 2009 HRTO 335, and Johnson v. Quality Home Services, 2013 HRTO 231.
order
5For the reasons set out above, the Application is dismissed as abandoned.
Dated at Toronto, this 21th day of August, 2017.
