DECISION
Adjudicator: David Muir Date: August 4, 2017 Citation: 2017 HRTO 1006 Indexed as: Tsegayewendenmagenhu v. Vertica Resident Services Inc.
1This is an Application filed under section 45.9(3) of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On June 2, 2017 the Tribunal wrote to the applicant by email requesting that he provide mutually agreeable dates to reschedule the hearing in this case. The applicant did not respond to this request and the time for doing so passed.
3On June 16, 2017 the Tribunal wrote to the applicant again by email directing that the applicant confirm his intentions with respect to this case. The applicant was directed that if he wished to proceed with the Application, he must respond to the June 2, 2017 email and provided dates for the hearing by June 23, 2017 failing which the applicant may be dismissed as abandoned.
4The emails were sent to the email address provided by the applicant in his Application and there is no indication that they were not received by him.
5The applicant did not respond as directed and does not appear to have made any contact with the Tribunal.
6In all of the circumstances I find that the applicant has abandoned this Application and it is dismissed.
Dated at Toronto, this 4th day of August, 2017.
