1This Application is scheduled to be heard in Toronto on July 29, 2016.

2A Notice of Hearing was sent to the parties on March 21, 2016. The Notice set dates for disclosure and production of documents pursuant to the Tribunal’s Rules of Procedure. The Notice of Hearing directed the parties that by June 14, 2016 they were to deliver witness statements, the list of the documents they intend to rely on and a copy of those documents to the other party and then file copies of all of these documents with a completed Statement of Delivery (Form 23) with the HRTO.

3The June 14, 2016 deadline for serving and filing relevant documents and witness statements passed and none of the parties had complied with the disclosure rules.

4In a Case Assessment Direction dated June 27, 2016 the applicant was directed to advise the Tribunal and the respondent in writing, by no later than July 4, 2016, if he wished to proceed with this Application.

5The CAD further directed the parties that if this Application is proceeding, they were to comply with the document requirements set out under Step Two of the Notice of Hearing by no later than July 14, 2016.

6The Tribunal has received no correspondence from the parties since November 2015. As a result, the Application is dismissed as abandoned.
