1On June 10, 2016, the Tribunal issued an Interim Decision, 2016 HRTO 791, which made the following order and direction:

1. The Application against the respondent franchisor [2165235 Ontario Incorporated o/a Bagel World] is dismissed.

2. Within two weeks of the date of this Interim Decision, the applicant shall send the Tribunal’s Registrar and the respondents a letter or an email, which confirms whether or not she intends to bring a motion in court to have the stay of the proceeding under the [Human Rights] Code against the respondent franchisee [2112412 Ontario Incorporated o/a Bagel World Thornhill] lifted.

2With respect to 2), the applicant has not sent the Tribunal’s Registrar a letter or an email, and the deadline for doing so has now passed. In the circumstances, the applicant is deemed to have abandoned the Application against the respondent franchisee.

3The Application against the respondent franchisee is dismissed.
