Human Rights Tribunal of Ontario
B E T W E E N:
Rosemary Selah Applicant
-and-
Fred Victor T2H Program Respondent
DECISION
Adjudicator: Josée Bouchard Date: July 4, 2016 Citation: 2016 HRTO 876 Indexed as: Selah v. Fred Victor T2H Program
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), on February 29, 2016.
2On April 4, 2016, the Tribunal issued a Notice of Intent to Dismiss ("NOID") on the basis that the Application is outside the Tribunal's jurisdiction because it fails to identify any specific acts of discrimination within the meaning of the Code. The Tribunal directed the applicant to file written submissions responding to NOID on or before May 4, 2016. The applicant was warned that a failure to respond may be considered an abandonment of the Application and it might be dismissed for that reason.
3The applicant has not responded to the NOID, the time for doing so has now passed and the NOID has not been returned as undeliverable.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 4th day of July, 2016.
