1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on July 13, 2015.
2On April 22, 2016 the respondent filed a Request for an Order During Proceedings (“Request”), seeking the dismissal of the Application pursuant to section 45.1 of the Code. The applicant did not respond to the Request.
3By Case Assessment Direction (CAD) issued May 13, 2016, the Tribunal cancelled the mediation scheduled for May 24, 2016 and directed the applicant to deliver and file her response to the respondent’s Request within 14 days of the CAD. The CAD warned the applicant that failure to respond may result in the Tribunal dismissing the Application as abandoned.
4The applicant has not responded to the Request or to the CAD and the time for doing so has passed. The CAD was sent to the applicant by regular mail and by email and has not been returned as undeliverable.
5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
