HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Frank DiGiulio Applicant
-and-
Workplace Safety and Insurance Board Respondent
DECISION
Adjudicator: Brian Cook
Indexed as: DiGiulio v. Workplace Safety and Insurance Board
1This Application was filed on November 9, 2015. The Application alleged that the respondent was taking too long to make a decision about the applicant’s claim for benefits. Shortly after the Application was filed, the respondent made a decision, denying the applicant claim for benefits.
2The Tribunal determined that further information was required from the applicant in order to process the Application. In addition, the Tribunal wanted to ensure that the applicant still wished to pursue the Application. In a Case Assessment Direction dated April 25, 2016, the applicant was directed to provide further information and submissions and to confirm that he wishes the Application to continue. The applicant was directed to do these things by May 23, 2016, and was advised that if he had not responded by May 23, 20155, the Application may be dismissed as abandoned.
3To date, the applicant has not responded to the Case Assessment Direction or otherwise communicated with the Tribunal. It appears that the Application has abandoned the Application and it is dismissed as abandoned.
Dated at Toronto, this 14th day of June, 2016.
