1On May 26, 2009, the applicant filed an Application with the Tribunal under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended.
2On June 27, 2012, the Tribunal issued an Interim Decision, 2012 HRTO 1269, which ordered that the Application be deferred pending the completion of a Claims Adjudication Officer’s proceeding.
3On January 20, 2016, the Tribunal sent the parties a letter, which provided the following direction to the applicant:
The Applicant is required to advise the HRTO whether the other proceeding is still ongoing and, if possible, when it is expected to be completed, within 30 days of the date of this letter. If the applicant fails to do so, the HRTO may dismiss the Application as abandoned.
4On March 1, 2016, the Tribunal sent the applicant a letter, which stated:
The HRTO has attempted, by email, to communicate with the applicant’s representative and the applicant directly on today’s date. Emails sent to the applicant and the applicant’s representative have bounced back as undeliverable.
The HRTO is sending this package to the applicant directly, as well as to the applicant’s representative.
The applicant’s attention is directed to the Advise of Status letter dated Jan. 20, 2016 which is enclosed.
The applicant has until March 15, 2016 to respond to the letter; otherwise the Application may be dismissed as abandoned.
5To date, the applicant has not responded to the Tribunal’s letters, or otherwise contacted the Tribunal. In the circumstances, he is deemed to have abandoned the Application.
6The Application is dismissed.
