1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of disability.
2On October 8, 2015, the Tribunal sent the applicant a Delivery of Response and Notice of Request to Dismiss Letter (the “Notice”). The Notice advised the applicant that the respondent asked the Tribunal to dismiss the Application because the applicant signed a full and final release regarding the same issues in dispute. The Tribunal directed the applicant to file written submissions in response to the Notice by October 22, 2015.
3The Notice warned the applicant that if he did not file written submissions by the specified date, then the Tribunal would make its decision based only on the information in the Application or may consider the failure to respond as an abandonment of the Application and dismiss it for that reason. On December 1, 2015, the Tribunal re-sent the Notice to the applicant and directed him to file submission as directed in the Notice. As of the date of this Decision, the applicant has not filed any submissions in response to the Notice. In the circumstances it appears the applicant has abandoned the Application.
4The Application is dismissed as abandoned.
