1This Interim Decision addresses the applicant’s request to re-activate his deferred Application.
2In his Application, the applicant alleges that the respondent discriminated against him because of disability contrary to the Human Rights Code, R.S.O. c. H. 19, as amended.
3By Registrar’s Letter dated September 14, 2015, the Tribunal deferred consideration of the Application pending the resolution of an appeal to the Divisional Court. The applicant has requested that the Tribunal re-activate his Application as the Divisional Court proceeding is now completed.
4The applicant’s request to reactivate his Application is granted.

5For the reasons set out above, the applicant’s Request to reactivate the Application is granted. The respondent must file a Response to the Application (Form 2) within 35 days of the date of this Interim Decision.
