1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on January 26, 2016.
2On March 9, 2016, the Tribunal issued a Notice of Intent to Dismiss the Application (“NOID”) on the basis that the Application appears to be outside the Tribunal’s power to decide for the following reasons: the issues raised appear to relate to the conduct of a lawyer representing a party in another legal proceeding; one of the individual respondents is an arbitrator, adjudicator or judge; and the Application fails to identify any specific acts of discrimination within the meaning of the Code allegedly committed by the respondents.
3The applicant was directed to respond to the issues raised in the NOID by no later than April 9, 2016. The NOID advised the applicant that failure to respond to the NOID may be considered an abandonment of the Application and it might be dismissed for that reason. On April 21, 2016, the Tribunal resent the NOID by email to the applicant.
4The applicant has not responded to the NOID and the Tribunal’s correspondence to the applicant has not been returned as undeliverable.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
