1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On February 4, 2016, the Tribunal issued a Notice of Intent to Dismiss the Application (“NOID”) containing the following information:
On November 16, 2015, the Human Rights Tribunal of Ontario (HRTO) sent you a letter to notify you that your Application was incomplete and could not be processed. You were asked to respond to specific questions outlined in the Notice of Incomplete Application by December 16, 2015. You were also asked to provide submissions with respect to your Application possibly being outside of the HRTO’s jurisdiction by December 16, 2015. As of today’s date, neither the requested missing information nor your submissions have been provided to the HRTO.
On December 14, 2015, due to the fact that the HRTO’s November 16, 2016 letter was returned by Canada Post, marked as, “return to sender / moved / wrong address”, the Notice of Incomplete Application and Notice of Intent to Dismiss Application letter was re-sent to you via email. You asked to both respond to the Notice and provide your current address to the HRTO by January 14, 2016,
Attached you will find a copy of the HRTO’s original November 16, 2015 Notice and a list of the questions you are required to answer. Please return the requested information and your submissions as outlined to the HRTO by February 11, 2016. The NOID was re-sent on December 14, 2015 by email.
If the HRTO does not receive the requested information by this date, your file may be closed and your incomplete application will be returned to you.
3The applicant has not responded to the NOID and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
