1The Tribunal is in receipt of the applicant’s April 22, 2016 request that the May 5 and 6, 2016 hearing dates in this matter be adjourned. The basis for the request is that the applicant’s counsel has recently been required to attend to an urgent and ongoing medical situation concerning a member of his immediate family. In addition, the applicant anticipates that she may have to travel out of the country soon to attend to a member of her immediate family, who is very ill.
2The respondent consents to the applicant’s request for an adjournment.
3I am satisfied that the applicant’s and her legal counsel’s personal circumstances are extraordinary circumstances that warrant an adjournment of the hearing. The May 2016 hearing dates are hereby adjourned.
4The Registrar will reschedule the hearing in consultation with the parties. The deadline for the exchange and filing of the parties’ pre-hearing disclosure pursuant to Rule 16 and 17 of the Rules of Procedure will be 45 days before the new hearing dates.
5The respondent indicates that, in the event that it is found to have any ongoing financial liability in this matter, it intends to argue that such liability ought not to accrue during the period of the adjournment. Any arguments the respondent wishes to make in this regard will be addressed at the hearing.
6I am not seized of this case.
