1This Interim Decision addresses the respondents’ objection to the request of the Canadian Union of Public Employees and its Local 2848 that it be granted intervenor status.
2The Request to Intervene was confirmed in correspondence dated July 24, 2014.
3The respondent filed a Request for Order (“Request”) on August 8, 2014 objecting to the granting of intervenor status.
4The Tribunal advised that it would not deal with the Request of the respondent as the Application was deferred.
5The Application has been reactivated. The respondent’s Request has not been withdrawn and remains outstanding.
6The respondent’s objection appears to have been based on the fact that the Application was deferred and it was inappropriate to add as an intervenor a party who was pursuing the respondent on the same issues in another forum.
7Given that the Application is no longer deferred there no longer appears to be any basis for the objection.
8As previously indicated in the Tribunal’s correspondence of July 24, 2014, the scope of the bargaining agent’s involvement will be determined by the adjudicator conducting the hearing.
