1This Application alleges discrimination with respect to employment because of age contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The Tribunal issued a Case Assessment Direction dated September 30, 2015, (“the CAD”) directing that a Summary Hearing be held by conference call hearing to determine whether or not the Application should be dismissed on the basis that there is no reasonable prospect that it will succeed. A Notice of Summary Hearing, dated October 19, 2015 (“the Notice”), was issued to the parties by regular mail scheduling the conference call hearing for January 12, 2016 commencing at 1:30 p.m. The Notice was not returned as being undeliverable to the applicant.
3The conference call hearing was held on January 12, 2016 commencing at 1:30 p.m. The respondent called into the call, but the applicant did not.
4In accordance with its usual practice, the Tribunal held down the start of the conference call hearing until 2:00 p.m. At that time, the applicant still had not called into the call, or otherwise communicated with the Tribunal. The Tribunal orally dismissed the Application as abandoned and stated that it would issue a Decision confirming this ruling.
5For these reasons, the Application is dismissed as abandoned.
