DECISION
Adjudicator: Ken Bhattacharjee
Indexed as: Baranyai v. Forrest Mechanical Inc.
1On August 9, 2010, the applicant filed an Application with the Tribunal under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended.
2On October 20, 2011, the Tribunal issued an Interim Decision, 2011 HRTO 1899, which ordered that the Application be deferred pending the conclusion of a proceeding before an Appeals Resolution Officer of the Workplace Safety and Insurance Board (“WSIB”).
3On January 12, 2016, the Tribunal sent the parties letter, which requested that they advise the Tribunal within 30 days of the status of proceeding before the WSIB. The letter specifically warned the applicant that if he failed to respond, the Tribunal may dismiss his Application as abandoned.
4To date, none of the parties have responded to the Tribunal’s letter. In view of the fact that the applicant has not responded, he is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 8th day of April, 2016.
