1This Application alleges discrimination contrary to the Human Rights Code, R.S.O. 1990, c.H.19, as amended (the “Code”).

2The applicant filed an email with his Application between himself and his employer which included the names of several clients of the respondent, all but one of which were redacted. The respondent is seeking an order removing the partially redacted email from the Tribunal file on the basis that the respondent is a health information custodian for the purposes of the Personal Health Information Protection Act, 2004, S.O. 2004, c.3, Sch.A, and therefore has an obligation to protect the privacy of its clients. The respondent argues that it is unnecessary to disclose the name of the client, as the client’s identity is not relevant to the issues in the Application. The respondent provided the Tribunal a copy of the email with all names redacted.

3The applicant opposes the request on the basis that the email does not disclose any personal health information relating to the client, though he does not indicate why the name of this client was not redacted like the others, or how the name of the client may be relevant to the issues raised in the Application.

4Though parts of the email do appear to be relevant to the issues in the Application, the name of the client is not. In the circumstances, the Tribunal will remove the non-redacted copy of the email from the Tribunal’s file and replace it with the copy provided by the respondent.
