1On September 8, 2014, the applicant filed an Application with the Tribunal under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended.
2On January 21, 2016, the Tribunal sent the applicant an Advise Intent letter, which set out the following information and direction:
On November 16, 2016 the Human Rights Tribunal of Ontario (HRTO) issued a letter asking the Applicant to provide the status of the other proceeding. The Applicant’s counsel responded to the Tribunal’s letter. A copy is attached. The Respondent’s and the Union also advised the Tribunal that the grievance has been withdrawn.
The Applicant is required to advise the HRTO his intent in regards to this Application. If he wishes to withdraw, he may file (Form 9) Request to Withdraw. If he wishes to proceed, he must file (Form 10) Request for Order During Proceedings, within 30 days of the date of this letter. If the applicant fails to do so, the HRTO may dismiss the Application as abandoned.
3To date, the applicant has not advised the Tribunal of his intent in regards to this Application.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
