1The hearing in respect of this Application is scheduled to continue on May 26 and 27, 2016 in Toronto.
2On March 15, 2016, the respondent filed a Request for Order During Proceedings that it be permitted to call additional witnesses that it had not identified through its witness lists and witness statements filed prior to the commencement of the hearing.
3The respondent requests to call the individuals, identified by the applicant and his witness during their earlier testimony as "Mark", "Bill" and "Narraine", as witnesses at the next hearing dates.
4The respondent requests the Tribunal to issue Summons to Witness for these three witnesses.
5The applicant has provided his consent to this request.
Decision
6Given that the applicant has consented to this request and there is sufficient time to prepare and deliver witness statements, the respondent's request to call these witnesses is granted.
Order
7The respondent's request to call "Mark", "Bill" and "Narraine" as witness when the hearing resumes on May 26 and 27, 2016 is granted.
8By April 11, 2016, the respondent shall serve on the applicant and file with the Tribunal witness statements for each of these witnesses.
9The Registrar will issue to the respondent Summons to Witness for each of these witnesses.
