1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on September 3, 2014.
2On October 21, 2014, the respondent filed its Response to the Application.
3On January 26, 2015, the Tribunal issued a Deferral of Application on Consent deferring the Application pursuant to Rule 14 of the Rules of Procedure pending the completion of another proceeding.
4On January 20, 2016, the Tribunal issued a letter requesting that the applicant advise the Tribunal whether the other proceeding is still ongoing and, if possible, when it is expected to be completed (“Letter”). The applicant was directed to respond to the Letter within 30 days and warned that failure to respond may be considered an abandonment of the Application and it might be dismissed for that reason.
5The applicant has not responded to the Letter, the time for doing so has now passed and the Letter has not been returned as undeliverable.
6In the circumstances, the applicant is deemed to have abandoned the Application.
7The Application is dismissed.
