1This matter is scheduled for hearing in Toronto on March 21 and 22, 2016.
2In the Confirmation of Hearing Notice issued and in accordance with Rules 16 and 17 of the Tribunal’s Rules of Procedure, the parties were directed to deliver to each other and file with the Tribunal copies of all documents on which they intend to rely at the hearing, as well as statements of the intended evidence of all witnesses, by February 5, 2016.
3On February 22, 2016 the Tribunal issued a Case Assessment Direction which directed the applicant to file her hearing materials by March 3, 2016. She was also directed to confirm in writing that she was proceeding with the Application and that she would be attending the hearing.
4On March 4, 2016 the Tribunal received correspondence for the respondent in advising that it has not received any materials from the applicant and that the matter should be dismissed as abandoned.
5As of this date the applicant still has not complied with the directives in the Case Assessment Direction and the time for doing so has passed. The applicant was warned that failure to comply with the Tribunal’s directions may result in the dismissal of her Application on the basis that it has been abandoned.
6Having considered the matter I am of the view that the applicant has abandoned the Application.
Order
7The Application is dismissed and accordingly the scheduled hearing dates are cancelled.
