INTERIM DECISION
Adjudicator: Douglas Sanderson
Indexed as: A.T. v. Children’s Aid Society of Ottawa and Children and Family Services for York Region
WRITTEN SUBMISSIONS
A.T., Applicant
Self-represented
1This Application, filed on July 31, 2015 under the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleges discrimination with respect to goods, services and facilities because of disability.
2In an earlier Interim Decision in this matter, 2016 HRTO 51, the Tribunal deferred this Application pending the conclusion of related child protection proceedings before the Court. The applicant filed a Request for an Order During Proceedings on February 8, 2016 seeking an order anonymizing all decisions in this matter to protect the identity of her children. The applicant cited section 45(8) of the Child and Family Services Act, R.S.O. 1990, c. C.11, which states as follows:
No person shall publish or make public information that has the effect of identifying a child who is a witness at or a participant in a hearing or the subject of a proceeding, or the child’s parent or foster parent or a member of the child’s family.
3The respondents have not responded to the request and the time for doing so has passed.
4Given the subject matter of this Application, it appears likely that any decisions in this matter will have the effect of identifying the applicant’s children, who are the subject of proceedings under the Child and Family Services Act, by reference to her name. Consequently, I find it appropriate to anonymize the Tribunal’s decisions in this matter by using the applicant’s initials, including previous decisions.
Order
5The Tribunal orders as follows
- The applicant’s request to anonymize this Application is granted. The Tribunal shall refer to the applicant using her initials in all of its decisions in this matter, including decisions that predate this Interim Decision.
6I am not seized.
Dated at Toronto, this 8th day of March, 2016.
