INTRODUCTION
1This Interim Decision addresses the applicant’s February 2, 2016 Request for an Order During Proceedings (“Request”) to reactivate her deferred Application. The respondent corresponded with the Tribunal to indicate that it had no objection to the reactivation of the Application.
2Rule 14.4 of the Tribunal’s Rules of Procedure states:
Where an Application was deferred pending the outcome of another legal proceeding, a request to proceed under Rule 14.3 must be filed no later than 60 days after the conclusion of the other proceeding, must set out the date the other legal proceeding concluded and include a copy of the decision or order in the other proceeding, if any.
3The applicant states that her reason for making this Request is that she has withdrawn Ontario Labour Relations Board (“OLRB”) claim number 3529-14-UR and on February 2, 2016 the OLRB issued a decision indicating that the application is withdrawn with leave of the OLRB.
DECISION
4Having reviewed the matter, I find that the Ontario Labour Relations Board proceeding is concluded and that it is appropriate for the Tribunal to reactivate the Application. The Tribunal will continue to process the Application.
5The respondents are directed to deliver and file their Responses to the Application within 35 days of receiving this Interim Decision.
ORDER
6The Tribunal makes the following Orders:
a. This Application is reactivated.
b. Within 35 days of the date of receiving this Interim Decision, the respondents shall file their Response(s) (Form 2) to the Application with the Tribunal.
7I am not seized.
