Introduction

1The applicant in this matter filed two separate Applications in relation to the same incident which involved the police and the applicant’s former landlord. The narrative in both Applications is identical.

2The Application involving the police is this Application, file number 2015-21726-I. The Application involving the applicant’s former landlord is Tribunal file number 2015-21725-I.

3The Tribunal issued a Notice of Intent to Dismiss in both Applications.

4By Interim Decision dated December 2, 2015 issued in this Application (2015 HRTO 1631), I held it was not plain and obvious that this Application is not within the Tribunal’s jurisdiction and as such, the Tribunal would continue to process the Application.

5By Interim Decision dated December 4, 2015 (2015 HRTO 1646), I dismissed the Application against the applicant’s former landlord on the basis that it was outside of the Tribunal’s jurisdiction.

6It has now come to my attention that the applicant also named his former landlord in this Application, in additional information provided by him.

7As stated earlier, the narrative in the two Applications is identical. I have dismissed the Application against the applicant’s former landlord in 2015 HRTO 1646. That decision applies to this Application. As such, the Application has been dismissed against the applicant’s former landlord and he is no longer a party to this Application.
