1By Applicant filed on July 31, 2015, the applicant alleged that the respondents discriminated against her contrary to the Human Rights Code, R.S.O. 1990 c. H. 19 (the "Code"). In the Application, the applicant indicated that the date of the incident of alleged discrimination was June 29, 2015. In her Reply, the applicant stated that the actual date of the incident was June 29, 2014. She also indicated that she was not at the Trillium Hospital in 2015.
2On December 3, 2015, the Tribunal issued a Notice of Intent to Dismiss ("NOID") on the basis that it appeared the Application was outside the HRTO's jurisdiction under s.34(1)(a) of the Code, as it was filed more than one year after the last incident of discrimination raised in the Application. The Tribunal directed the applicant to provide written submissions responding to the timeliness issue identified in the NOID by January 16, 2016. The Tribunal advised the applicant that it might consider the failure to respond to the NOID as an abandonment of the Application and dismiss the Application for that reason.
3The applicant did not respond to the NOID by the deadline set out in the NOID, nor has she communicated with the Tribunal regarding her Application following the NOID.
ORDER
4Due to the applicant's failure to respond to the NOID, her Application is dismissed as abandoned.
