1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of race and colour and reprisal.
2By letter dated November 9, 2016, the Tribunal informed the parties that its records indicate that the parties have settled this matter, but have not filed a Confirmation of Settlement Form (Form 25). The Tribunal directed the parties to file a completed Form 25 by November 25, 2016, in order that the Tribunal may close the file on the basis of the settlement. The Tribunal advised that if it did receive a completed Form 25 or confirmation that the applicant intends to proceed with the hearing by November 25, 2016, then it may deem the Application to be abandoned and dismiss it on that basis. Following a request from respondent’s counsel, the Tribunal extended this deadline to December 2, 2016. When no Form 25 was filed, the Tribunal issued another letter, dated December 7, 2016, extending the deadline to December 14, 2016, and advising the parties that no further extensions would be granted.
3As of the date of this Decision the Tribunal has received neither a Form 25 completed by the parties nor confirmation that the applicant intends to proceed with the Application. In the circumstances, it appears the Application has been abandoned.
4The Application is dismissed.
