1On January 5, 2016, the Tribunal issued Interim Decision 2016 HRTO 8, which deferred this Application pending the conclusion of the grievance proceeding.
2On January 11, 2016, the applicant filed a Request to reactivate the Application. He included an email to the intervenor confirming that he is withdrawing his grievance.
3The respondent and the intervenor have not filed a Form 11, response to the Request to reactivate, and the time for doing so has passed.
4In these circumstances I am satisfied that the grievance proceeding is concluded and that the Application should be reactivated.
Order
5The Tribunal orders as follows:
a. Within 35 days of the date of this Interim Decision the respondent must file with the Tribunal a Form 2, Response; and
b. In accordance with the Tribunal’s practice the applicant will be provided 14 days to deliver and file a Reply to the respondent’s Response.
