1On April 1, 2015, the applicant filed an Application with the Tribunal under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended.
2On August 10, 2015, the Tribunal issued an Interim Decision, 2015 HRTO 1059, which ordered that the Application be deferred pending the conclusion of the proceeding before the respondent.
3On September 2, 2016, the Tribunal sent the parties a letter, which provided the following direction to the applicant:
The Applicant is required to advise the HRTO whether the proceeding with the Workplace Safety and Insurance Board is still ongoing and, if possible, when it is expected to be completed, within 30 days of the date of this letter. If the applicant fails to do so, the HRTO may dismiss the Application as abandoned.
4To date, the applicant has not responded to the Tribunal’s letter, or otherwise contacted the Tribunal. In the circumstances, he is deemed to have abandoned the Application.
5The Application is dismissed.
