2On November 2, 2016, the Tribunal issued a Case Assessment Direction. It noted that the applicant had commenced a civil action in which she seeks an order with respect to an alleged infringement of her rights under the Code. The Case Assessment Direction stated:
In these circumstances, the applicant may not be permitted to continue with the Application. The applicant may make submissions about whether the Application should be dismissed under section 34(11) of the Code by November 18, 2016. If submissions have not been received by that date the Application may be dismissed as abandoned. The respondent is not required to make submissions unless directed to do so.
3The applicant has not made submissions or otherwise contacted the Tribunal.
4In these circumstances, the Application is dismissed as abandoned. The hearing scheduled for December 5, 2016, is canceled.
