Introduction
1This is an Application filed under section 34 of the Human Rights Code, R.S.O. 1990, c.H.19, as amended (the “Code”), alleging discrimination with respect to employment. This Interim Decision addresses the respondent’s Request for Order During Proceedings (“Request”) for particulars.
2The respondent asks the Tribunal to order the applicant to provide particulars of the ground(s) of discrimination or harassment on which he relies to permit the respondent to prepare for the hearing and meet its obligations for delivery and filing of hearing documents and witness statements.
3The applicant responded to the Request and indicates that he is relying on the grounds of disability, threat of reprisal, and reprisal. He adds that the respondent was aware of his health issues and failed to accommodate his needs and threatened to terminate him because of his sick time.
Decision
4The applicant has already responded to the substance of the Request and no order is required with respect to the respondent’s request for particulars.
5The applicant did not check off the specific grounds on which he relies in the Application. He did, however, allege that the respondent denied him accommodation, engaged in workplace harassment or bullying and discriminated against him in the imposition of discipline.
Order
6No order. The applicant responded to the respondent’s request for particulars.
