1This is an Application filed under section 45.9(3) of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended.
2On August 9, 2016 the respondent filed a Response to the Application together with a Request for Summary Hearing. The respondent asserts that the Application should be dismissed because it has no reasonable prospect of success and/or because the substance of it has been appropriately dealt with in another proceeding.
3On August 14, 2106 the applicant requested an extension of time to file a response to the respondent’s positions. An extension was granted to September 20, 2016.
4The applicant did not respond as directed.
5On October 24, 2016 the Tribunal wrote to the parties directing that the applicant respond to the respondent’s positions by October 31, 2016 failing which the Application may be dismissed as abandoned.
6On November 4, 2016 the respondent wrote to the Tribunal copied to the applicant seeking the dismissal of the Application.
7The applicant has not respond to any of the Tribunal’s directions and has made no contact with the Tribunal in some time.
8In all of the circumstances I find that the applicant has abandoned this Application and it is dismissed.
