Introduction

1This Interim Decision addresses the applicant’s request to re-activate his deferred Application, which was filed on October 22, 2014, under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).

2By Interim Decision dated August 17, 2015, the Tribunal ordered that the Application before this Tribunal will be deferred pending the conclusion of the proceeding before the Landlord and Tenant Board.

3On September 18, 2016, the applicant sent a fax to the Registrar which indicated that the Landlord and Tenant Board had issued a final decision on his application to the that Board on July 18, 2016 and has issued a decision on the applicant’s request to have that July 18, 2016 decision reviewed. The applicant attached these decisions to his fax.

4The applicant also filed a Request for Order During Proceedings (Request) to reactivate the Application.

5The respondent has not filed a Response to this Request and the time to do so has now passed.

6It would appear that the proceeding before the Landlord and Tenant Board is now concluded, the Tribunal grants the applicant’s Request to reactivate.

Order

7For the reasons set out above, the Tribunal orders as follows:

a. The applicant’s request to reactivate the Application is granted; and,

b. On or before November 9, 2016, the respondent shall notify the Tribunal and the applicant if it wishes to engage in the Tribunal’s mediation process.
